FAQ
What happens if I renounced the inheritance and the document isn't legalized?
The other heirs or the registry may keep treating you as an heir, debts included. Once legalized, the renunciation holds up against everyone.
Why legalize a renunciation of inheritance?
To prove to other heirs or authorities that you renounced the inheritance.
How much does it cost?
The professional fee, from $40, covers the legalization and, if applicable, the apostille; official fees are separate.
Do I need it apostilled?
Only if you'll use it outside Venezuela; we'll guide you.
Do you prepare the renunciation?
Here we legalize one that's already been signed; preparing it is a separate notary service.
About this procedure
A renunciation (or repudiation) of inheritance is the act by which an heir formally declares that they don't accept the inheritance they're entitled to, often to avoid taking on the deceased's debts or so their share passes to another heir. It's a serious decision, and the law requires it to be express and recorded in a public instrument (art. 1,012 of the Venezuelan Civil Code); in practice it is signed before a Notaría Pública (government notary office) or a registry. As a rule it is final, and you may only accept later if your right has not lapsed (10 years) and no other heir has accepted. When it has to take effect outside the country, or the person renouncing lives abroad, it must be legalized and apostilled. We start from the renunciation already signed: we handle its legalization through the online system of SAREN (Venezuela's registries and notaries service) and process the apostille at the MPPRE (Venezuela's Ministry of Foreign Affairs, which issues apostilles). We hand you the document ready so your decision is fully valid. If you haven't formalized it yet and need guidance on the consequences of renouncing, a lawyer advises you before you take that step; we can also handle the signing of the document as a separate service.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · 1961 Hague Apostille Convention
- Without SENIAT's estate tax compliance certificate (solvencia sucesoral), inherited assets can't be sold or transferred, not even if you're an only child.
- If the data doesn't match the system, the procedure is rejected.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
