Clarification of a recorded deed

Filed with the Real Estate Registry · SAREN

We correct, at the registry, an unintentional error or omission in your already recorded document, with the clarification deed (aclaratoria) and its marginal note (annotation added to a recorded document). It fixes that slip that's holding everything up.

FAQ

What happens if I leave the error in the recorded document?

A wrong cédula, boundary or detail blocks your next sale, mortgage or inheritance. The registry won't record anything on top of an error without clarifying it first.

Does a clarification deed change what the document says?

It only corrects unintentional errors, not the substance, and the error has to be proven.

How much does it cost?

The professional fee, from $120, covers drafting, the visado and recording the clarification deed; the official registry fee is separate and low.

Do the same parties have to sign?

Yes, the parties to the original document; we tell you who needs to appear.

What if the error is substantive?

Then a clarification deed isn't enough; we tell you which route applies.

About this procedure

It happens more often than you'd think: you realize that your recorded property document has an error. A boundary described wrong, an incorrect cédula (Venezuelan national ID card) number, a misspelled name, a property detail left incomplete. And that small slip can stall a sale, a loan or an inheritance until it's corrected. The legal tool for this is the clarification deed, which is recorded at the registry and reflected through a marginal note on the original document. But it needs to be said clearly, and we say it: a clarification deed is for correcting unintentional errors or omissions, not for changing the substance of the deal or rewriting what was agreed at will. And you have to show the registry, with the proper proof, that it really was an error. We review your document, pinpoint the error and the right way to fix it, draft the clarification deed with its supporting evidence, and record it so the marginal note goes on file and your document finally says what it should. We fix that detail that has everything stuck.
