FAQ
What happens if my company changed its name and the trademark still has the old details?
It holds up renewals and defenses: when you want to file an opposition or renew, SAPI sees an owner that no longer exists under that name.
Is it the same as an assignment?
No: in an assignment the owner changes; here the owner is the same and only their details change.
How much does it cost?
The professional fee from $110 covers preparing and recording the change at SAPI; SAPI's fee is paid separately.
When is it needed?
When you change your company name, merge or update your details.
What do I need?
The registered minutes of the change and the trademark details.
About this procedure
Over time, a trademark owner's details can stop matching reality: the company changed its legal name, it merged, the individual's details changed, or the registration simply holds outdated information. Unlike an assignment, the owner doesn't change here (it's still the same one); what changes is how the owner is identified in SAPI's register. It looks like a minor detail, but the register has to show who the owner really is.
The issue shows up at the worst moment: when you go to renew the trademark, license it, defend it against a third party or use it as backing in a transaction, and SAPI sees an owner that no longer exists under that name or whose details don't match the company's current documents. That inconsistency can hold up the urgent procedure and force you to sort out the update first, under pressure. Keeping the owner's details current means a pending formality won't stall something important.
We bring the register in line with reality: we check which owner details need updating, gather the supporting documents that prove the change, and handle the ownership change at SAPI so your trademark appears correctly in the name of its true owner. The price starts at $110 and is adjusted to the case. A lawyer reviews your situation and confirms with you before we start, no strings attached.
Legal framework and important notes
Ley de Propiedad Industrial (Industrial Property Law)
- It updates the owner's details when the owner stays the same. Change of company name, merger or the individual's or company's details.
- It's different from Trademark assignment, where the owner changes.
- Outdated details hold up renewals, licenses and defenses.
- It may require a name change at the Commercial Registry.
- SAPI's fees are paid separately.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
