FAQ
What happens if I buy without a lien certificate?
You could buy a property that's mortgaged, under attachment or banned from sale, and the issue becomes yours. It's the document no buyer should skip.
What does the lien certificate certify?
Whether the property has any active mortgages, attachments or bans.
How much does it cost?
The professional fee, from $65, covers the request and the reading of the result; the official registry fee is separate.
How many years does it cover?
It's requested for the last 20 years; that way no encumbrance stays hidden.
What if something bad turns up?
We tell you straight and help you sort it out, or walk away from the purchase.
About this procedure
A lien certificate is probably the most important document to have in hand before buying a property, and it's the one that reveals any danger. This certificate, issued by the registry itself, tells you whether the property carries an unreleased mortgage, an attachment, a ban on selling or encumbering, a usufruct, an easement or any other encumbrance that limits what you can do with it. It's normally requested for the last twenty years, the period the registry works with, so nothing in the recent history slips through. Buying a property without this certificate is like buying a car without opening the hood: it looks great on the outside, but inside there could be a mortgage that's now yours to deal with, or an attachment that freezes the property. We request and obtain the property's lien certificate, review it with a lawyer's eye, and explain in plain language whether it's clean, or what encumbrance it carries and what that means for you. The document that separates a good purchase from a nightmare.
