Loan for use (comodato)
It's the agreement for lending something free of charge: you lend an asset, movable or real property, so someone else can use it for a while and give it back, without charging anything. If there were payment, it would be a lease. It's authenticated before the notary to make the term, the use and the obligation to return it clear.

FAQ
What happens if I lend my asset on a handshake?
Without a contract you can't prove it was a loan or force its return; over time, whoever has it may claim you lent it forever, or even that it was theirs.
Can I charge for a comodato?
No; if you charge, it's a lease, which is a different contract.
How much does it cost?
The professional fee, from $50, covers drafting and authentication; the official notary fee is separate.
Does it work for real estate and vehicles?
Yes, for any asset; it's authenticated before the notary.
What if it's agricultural land?
It may require authorization from the Instituto Nacional de Tierras; we check that for your case.
About this procedure
A comodato (loan for use) is the contract by which one person hands an asset, movable or real property, to another so they can use it free of charge for a period of time and then return it. The key word is free: if the person receiving the asset pays anything for its use, it's no longer a comodato, it's a lease, with different rules. Comodato is used all the time in everyday life, sometimes without people realizing it: lending a house to a relative, letting a foundation use a commercial space, giving a company the use of a vehicle or some equipment. The catch is that, because it happens between people who know each other and no money changes hands, it's almost always done on a handshake, and that's where the trouble starts: it isn't clear for how long, in what condition the asset must be returned or who pays the expenses, and sometimes the person who received it simply won't give it back. That's why it pays to put it in writing and have it authenticated: we set out which asset is lent, for what use, for how long, who covers upkeep costs, and the obligation to return it in good condition. One thing to keep in mind: if the comodato covers land suited for farming, notaries and registries require authorization from the Instituto Nacional de Tierras (national land institute). The contract is authenticated before the notary to give it fecha cierta (a legally certain date, so the document holds up against third parties) and legal force.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- The key to a comodato is that it's free; the moment there's payment, it becomes a different contract
- Document the asset's condition when you hand it over, so you can demand it back the same way
- Watch out for agricultural land, which requires authorization from the Instituto Nacional de Tierras
- And don't leave a comodato on a handshake. The authenticated paper is what lets you get your asset back
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
