FAQ
What happens if I keep my accounting overdue?
Every month that goes by adds another unfiled return and another fine. SENIAT penalizes failure to file, and until you catch up you can't get a compliance certificate or apply for credit.
How much does catching up cost me?
The professional fee is from $200, depending on how many periods you owe; your accountant gives you the figure after reviewing. Any resulting fines and taxes are separate.
Am I going to be fined?
SENIAT can penalize failure to file; regularizing as soon as possible reduces the risk. We file and calculate whatever results.
Do you pay the fine?
No, you pay the fine; we calculate it and file.
And after that?
Ideally, you move to the monthly plan so it doesn't happen again.
About this procedure
Falling behind on your accounting is a snowball. It starts with one month that slipped by, then another, and suddenly the company has gone half a year or more without filing. The catch is that SENIAT doesn't forget: not filing returns, or filing them more than a year late, can cost fines ranging from 100% to 300% of the unpaid tax, and for legal entities even the closure of the business for several calendar days. A delay that looked like an oversight turns into a serious threat to the business.
This service is the rescue. We review which periods you have pending, rebuild your accounting for those months from your invoices and bank statements, and file the missing returns to regularize your situation with SENIAT. The goal is simple: get you out of risk and into good standing, with the peace of mind that you no longer have a tax time bomb hanging over you.
The price starts at $200 and goes up with how many periods or years need to be rebuilt: catching up on three months isn't the same as catching up on two years. Honesty first: the sooner you face it, the cheaper and simpler it is, because the backlog only grows, and so do the penalties. And once we've cleaned things up, the natural next step is not falling behind again: we set you up with Monthly accounting so the company always stays up to date without you having to think about it. Your accountant reviews your case and gives you the exact figure before we start, no strings attached.
Legal framework and important notes
Código Orgánico Tributario (Organic Tax Code) · Ley del IVA (VAT Law) · Ley del ISLR (Income Tax Law)
- SENIAT can penalize failing to file or filing returns late with fines of 100% to 300% of the unpaid tax and, for legal entities, closure of the business
- The base price covers a short backlog; it goes up with the number of periods to rebuild
- The taxpayer covers the payment of taxes, fines and interest
