Counter-guarantee
It's the document that protects someone who gave a guarantee or became a guarantor for another person: it obliges that person to reimburse everything they end up paying. It's the guarantee for the guarantor, and it keeps the guarantor from being left carrying someone else's debt with no backing.

FAQ
What happens if I become a guarantor without a counter-guarantee?
If you pay someone else's debt, collecting from the debtor comes down to your word. With a signed counter-guarantee, you have the right in writing and with fecha cierta (a legally certain date, so the document holds up against third parties).
What exactly is it for?
So that, if you pay someone else's debt because you were their guarantor, you have in writing the right to get that money back.
How much does it cost?
The professional fee, from $55, covers drafting and authentication; the official notary fee, per page, is separate.
Who needs it most?
Guarantors, surety companies and partners who back their company.
Can it include interest?
Yes, and we recommend it. It's signed in person, with a valid cédula.
About this procedure
A counter-guarantee is the flip side of a guarantee: while the guarantee protects the creditor, the counter-guarantee protects the person who gave that guarantee or became a guarantor for a third party. Here's how it works: if you agree to be a guarantor for a friend, or give a guarantee on behalf of a company, you run the risk of ending up paying a debt that wasn't yours. The counter-guarantee is the document in which the person you vouched for formally commits to reimburse you for everything you've had to pay, plus expenses and interest. It's especially important in the business and financial world, where a surety company or a partner gives guarantees on behalf of someone else and needs to secure their right of recovery. We draft the counter-guarantee setting out clearly the amount to be reimbursed, the terms, the interest and how it would be enforced if the time came, and we have it authenticated at the notary office so it's fully valid. If what you're looking for is to give the original guarantee, see our Surety agreement (fianza) or Guarantee agreement; the counter-guarantee is the step that protects you as guarantor.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- The common mistake is giving a guarantee or becoming a guarantor without signing a counter-guarantee
- If that happens and you end up having to pay, getting your money back becomes an uphill battle
- The counter-guarantee, signed beforehand, is what turns your right to reimbursement into something enforceable
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
