FAQ

What happens if I let the trust expire?

When it expires, the protection and management end and the assets are exposed again. Extending it in time keeps the shield in place without having to set everything up again.

Can I extend a trust that has already expired?

It's best to do it before it expires; we advise you based on your case.

How much does it cost?

The professional fee, from $60, covers the advice and handling of the change; the trustee's commission is separate.

Can I add assets or change beneficiaries?

Yes, through the extension, without setting up a new one.

Is the trustee needed?

Yes, the change is formalized with the trustee; we go with you.

About this procedure

A trust extension is the service for adjusting a trust that already exists, without having to set up a new one from scratch. Circumstances change: a trust agreed for a set term may need to be extended; it may make sense to add to the assets it holds, or to add or change beneficiaries; or the management terms may need to be adjusted to the settlor's new goal. All of that is done through an extension or amendment of the original trust. Just as when it was created, the trust is managed by an authorized trustee institution, a bank, so the change has to be negotiated and formalized with it. Our role is advisory: we review the current instrument to understand exactly how it was set up, advise you on what's worth changing and how, draft and review the new terms, and support you in dealing with the trustee, making sure the extension keeps your assets shielded and fits what you need today. It's an advisory and structuring service, not a simple procedure, because a poorly made adjustment can distort the whole trust.
