FAQ
What happens if I leave a valuable property without a structure to protect it?
It's exposed to fights among heirs, poor management or a creditor going after it. A trust takes it out of that risk with clear rules.
What does putting a property in a trust mean?
Handing it to a trustee who manages it the way you define; we structure it and record it.
How much does it cost?
The professional fee, from $200, covers structuring, drafting and recording; the registry fee is extra and based on the asset's value, and the trustee's commission depends on the bank.
Who can be the trustee?
By law, an authorized institution, such as a bank.
Can I be the beneficiary?
Yes, the settlor can set it up in their own favor.
About this procedure
A trust (fideicomiso) is a high-level tool for protecting and managing assets: the owner (the settlor, or fideicomitente) transfers the property to a trustee (fiduciario), who manages it under precise instructions for the benefit of the people the owner names (the beneficiaries). It's the tool people use when they want to shield a property from risk, make sure a property is well managed for minor children or relatives who can't manage it themselves, or structure an inheritance in a sophisticated, conflict-proof way. It takes careful legal design: clearly defining the trustee, the instructions, the beneficiaries and the conditions, and recording the transfer of the property into the trust at the registry. It isn't a template document; it's asset architecture. We advise you on whether a trust is the right vehicle for your goal, design the full structure, draft the document and record it, coordinating with the trust institution that will act as trustee. You protect your assets with the same instrument the great fortunes use.
