FAQ

What happens if I leave my assets without a structure that protects them?

They're exposed to poor management, disputes among heirs or a third party getting hold of them. A trust ring-fences them and puts a professional in charge of managing them with a clear purpose.

Can I be the trustee myself?

No. By law, the trustee must be an authorized institution, such as a bank.

Is it expensive?

The trust institution's fee depends on the bank; our professional fee for advice and structuring starts at $90; the official notary or registry fees are separate.

What is it for?

To protect, manage, secure or pass on assets.

Can I be the beneficiary?

Yes, the settlor can set it up in their own favor.

About this procedure

A trust is one of the most powerful estate-planning tools there is, and also one of the least understood. Here's how it works: a person, the settlor, transfers one or more assets to another, the trustee, who commits to managing them for the benefit of the settlor or of a third party, the beneficiary, according to a clearly defined purpose. It has many uses: protecting assets, managing an estate for a minor or an elderly person, securing performance of an obligation, or planning and organizing an inheritance in an ironclad way. Now, there's a fundamental legal point to be clear on from the start: in Venezuela, under the Ley de Fideicomisos (Trust Law) and banking regulations, the trustee, the one who manages the assets, has to be an authorized institution, typically a bank. That's why our role here goes beyond a simple document: we're your advisors. We help you define what you want to achieve, design a trust structure tailored to you, draft and review the terms, and support you in negotiating and setting up the trust with the trust institution, making sure your interests are well protected in your dealings with the bank. It's an advisory and structuring service, not a stand-in-line paperwork errand, and that's why it makes a real difference in protecting your assets.
