FAQ
What happens if I got divorced abroad and don't get it recognized here?
In Venezuela you're still married: you can't remarry or freely dispose of your assets, and your ex-spouse keeps rights over them.
Is a divorce granted abroad valid here right away?
No. It first needs an exequatur from the TSJ, and then we record it in the Registro Civil.
How much does it cost?
The professional fee, from $130, covers recording the judgment once it has the exequatur; the exequatur proceeding, official registry fees and the translation are quoted separately.
Do you handle the exequatur?
Yes, as a separate service; we take you through that route before the recording.
What does the timing depend on?
Mostly on the exequatur before the TSJ, which doesn't depend on us; the recording afterward is quick.
About this procedure
Here's a very costly mistake many people make: believing that a divorce decree issued abroad can be recorded directly in the Venezuelan Registro Civil (Civil Registry: births, marriages, deaths) like any other certificate. It can't. A foreign judgment has no effect in Venezuela on its own: it first has to go through the exequatur, the proceeding before the Tribunal Supremo de Justicia (Supreme Court of Justice) that recognizes the foreign judgment and makes it valid in Venezuela. Only after the exequatur is granted can that divorce be recorded and take effect here, allowing you, for example, to remarry in Venezuela or update your marital status. Skipping the exequatur means the recording gets rejected and you lose time and money. We handle the whole process, in the right order: we file the exequatur with the TSJ (a separate service, quoted for your case), with the judgment duly apostilled (Hague Convention certification for use abroad) and translated, and once it's recognized, we record it at the Registro Civil. Two procedures linked together, with a lawyer in charge from start to finish.
Legal framework and important notes
Ley Orgánica de Registro Civil (Organic Civil Registry Law) · Código Civil (Civil Code) · 1961 Hague Apostille Convention
- ⚠️ A foreign divorce decree is NOT recorded directly. It first requires an exequatur before the TSJ (article 53 of the Ley de Derecho Internacional Privado, Venezuela's Private International Law Act) to be recognized; then it's recorded in the Registro Civil
- The judgment must come apostilled and translated
- The exequatur is a separate service that we also handle
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
