FAQ

What happens if I don't get the interdiction note entered?

The person still appears to have full capacity: they can sign, sell or take on debt, and no one is warned. The marginal note is what protects them before third parties.

Does this put the interdiction on record?

Yes. We enter the marginal note of the interdiction, already ordered by the court, on the corresponding record.

How much does it cost?

The professional fee, from $45, covers handling the marginal note; official registry fees, if any, are extra.

Why is the interdiction note necessary?

Because without it, the record doesn't show the interdiction and the person still appears to have full capacity.

What do I need?

The certified copy of the judgment with its enforcement order (auto de ejecución).

About this procedure

When a court declares a person's interdiction or partial incapacity (inhabilitación), usually because a condition keeps them from managing their assets or taking care of themselves, that decision must be entered in the Registro Civil as a marginal note on their birth certificate. This is essential to protect that person and their family: it makes it public and official that the person declared under interdiction can't carry out certain acts on their own, and that they act through their appointed guardian or curator. Without that annotation, a third party could unknowingly enter into an invalid deal with someone who legally lacks capacity, creating a mess for everyone. We make sure the final interdiction or partial incapacity judgment is properly entered as a marginal note at the Registro Civil, and we hand you the updated record. A protective procedure that's often forgotten, but that legally shields the family and the person's assets.
