FAQ
What happens if my partner and I emigrate with a prenuptial agreement that isn't legalized?
Abroad, nobody recognizes the property regime you agreed on; in a purchase, a debt or a separation, the other country's rules apply.
Do you draft the prenuptial agreement?
Here we legalize agreements that are already signed; if you need one drafted, that's a separate notary service.
How much does it cost?
The professional fee, from $35, covers the legalization at the Registro Principal and the apostille; official registry fees are separate.
Why are they legalized?
To enforce the couple's property regime before the authorities, especially abroad.
Do I need the original?
Yes, in good condition.
About this procedure
A prenuptial agreement is the agreement spouses or future spouses use to set the rules for their property, usually keeping it separate from the default marital property regime. Once it has been signed before a Notaría Pública (government notary office) or a registry, it usually needs legalization by the Registro Principal and an apostille to be valid outside the country or before certain agencies. We start from your already signed agreement: we check that it was properly formalized, handle its legalization at the Registro Principal or through the online system of SAREN (Venezuela's registries and notaries service), and if you'll use it abroad we process the apostille at the MPPRE (Venezuela's Ministry of Foreign Affairs, which issues apostilles). It's a key document for couples with assets or businesses in several countries. If you haven't signed one yet and want to protect your assets, that's a service we also offer; we guide you based on your case.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · 1961 Hague Apostille Convention
- We start from the document already signed before a notary office.
- Digital legalization is as valid as the wet-ink stamp; confirm what the receiving institution requires.
- If the details don't match the system, the procedure is rejected.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
