FAQ
What happens if I won the paternity lawsuit and don't legalize the ruling?
As far as institutions are concerned, the parentage stays as it was. The legalized ruling is what makes the court's decision effective.
Does this resolve the paternity lawsuit?
No. We legalize the ruling you already obtained; the lawsuit is a separate service.
How much does it cost?
The professional fee, from $40, covers the legalization at the Registro Principal; official registry fees are separate, and the apostille is added if it's going abroad.
Do I need it apostilled?
Only if you'll use it outside Venezuela; we'll guide you.
Does the ruling have to be final?
Yes, final and unappealable; we check it for you beforehand.
About this procedure
A paternity challenge contests a parentage that's already established, and a paternity suit seeks a court declaration of a parental tie that the presumed father didn't acknowledge. Both are contested matters decided by the court for the protection of children and adolescents through ordinary proceedings, not through voluntary (uncontested) proceedings. Once you have the final ruling, for it to take effect before the Registro Civil (Civil Registry: births, marriages, deaths) and other agencies, it usually needs legalization by the Registro Principal. Here we handle the legalization of the ruling you already obtained and hand it to you ready to use, and if you need it abroad, we process the apostille (Hague Convention certification for use abroad). If you're still in the lawsuit or need to file it, we handle that proceeding before the child protection court as a separate service; tell us where you stand.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · 1961 Hague Apostille Convention
- The best interests of the child always come first.
- Contested matters are decided by the child protection court; here we legalize the resulting document.
- If the data doesn't match the system, the application is rejected.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
