FAQ
What happens if I let others use my work without a written license?
There's no defined scope, term, territory or royalties: the other party uses it however they want and you have no way to collect or set limits. The license is what turns your work into income.
Do I lose the work when I license it?
No: you're still the owner; you only authorize its use.
How much does it cost?
The professional fee from $150 covers drafting the license agreement; SAPI's fee, only if the case requires recording, is paid separately.
How is it different from an assignment?
An assignment transfers ownership; a license transfers only the use.
What should it define?
Scope, term, territory and royalties.
About this procedure
You don't always want to sell your work: often the smart move is to rent it out. A copyright license is the contract through which you, without giving up ownership, authorize someone else to use or exploit your work in exchange for compensation. A publisher that publishes your book for a set time, a company that uses your music in its content, a developer that integrates your software: they all operate under a license, not ownership. You remain the author and the owner, and the work keeps earning you income.
The difference from an assignment is huge and worth being clear about: in an assignment you transfer ownership and the work becomes someone else's; in a license you only authorize use and you keep ownership. Mixing them up, or signing a poorly drafted license, is the source of the worst headaches: uses that stretch beyond what was agreed, territories or terms that were never defined, royalties you can't collect because the contract is ambiguous. A good license says exactly what can be done with the work, for how long, where and in exchange for what.
We draft and formalize that agreement: we define the scope, term, territory and compensation, and leave the license clear and protected for both parties. The price starts at $150 and is adjusted to the case. A lawyer reviews your situation and confirms with you before we start, no strings attached.
Legal framework and important notes
Ley de Propiedad Industrial (Industrial Property Law) · Ley sobre el Derecho de Autor (Copyright Law)
- The right is born when the work is created. Registration doesn't create it; it provides proof of fecha cierta (a legally certain date, so it holds up against third parties) and of authorship.
- It authorizes use without transferring ownership. The author remains the owner.
- It's different from an assignment, which does transfer ownership.
- It must define scope, term, territory and compensation.
- It's best to register the work first.
- Fees are paid separately.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
