FAQ

What happens if I sell liquor without a license?

The law provides for confiscation of the merchandise and closure of the premises for ten days; if it happens again, the closure is permanent.

Why is the Consejo Comunal involved?

The law requires the city hall to grant the license with the favorable, binding opinion of the area's Consejo Comunal.

Can I open while the license is in process?

Some city halls issue a provisional permit; we request it if your ordinance allows it.

How much does it cost?

The professional fee, from $250, covers full handling; the city hall's fees and revenue stamps are separate.

Do I need the patente first?

Yes. The law requires both a liquor license and a patente to sell liquor.

About this procedure

The Licencia de Expendio de Especies Alcohólicas, which everyone calls the liquor license, is the permit the city hall gives you to sell or serve alcoholic beverages on your premises: liquor store, bodegón (specialty food and liquor shop), corner grocery, restaurant, bar or tasca (Spanish-style tavern). The Ley de Impuesto sobre Alcohol y Especies Alcohólicas (Alcohol and Alcoholic Beverages Tax Law) is clear: liquor can only be sold at establishments that have their liquor license and their patente (business license). Selling without it leads to confiscation of the merchandise and closure of the premises, and if it happens again, the closure is permanent.
And it isn't a stand-alone procedure. The same law requires the municipality to grant the license with the favorable, binding opinion of the area's Consejo Comunal (local community council), so before you get to the city hall you have to go through the community. Then come the premises' distances from schools, hospitals, places of worship and other protected sites, zoning, the fire department (Bomberos), health (Sanidad), the municipal compliance certificate and the patente itself. Each city hall regulates it through its liquor ordinance, and some issue a provisional permit while the final license comes through. A missing document or a poorly drafted set of community minutes is what leaves the case file stuck for months.
We map out the whole path for you: we check that your premises meet the distance and zoning rules, go with you to get the Consejo Comunal's approval, organize the folder, request the provisional permit if your city hall issues one and handle the final license. If your operation requires it, we also review your registration with SENIAT (Venezuela's tax and customs authority). The price starts at $250 and is adjusted to your municipality and the type of sale. A lawyer reviews your case and confirms it with you before we start, no strings attached.
