Microloan agreement

Before a government notary office · SAREN

It's the contract for a low-amount loan, typical of financing for entrepreneurs, microbusinesses and small businesses. It works like a loan, with an amount, installments and interest, but for small, quick transactions. It's authenticated before a notary and respects legal limits.

FAQ

What happens if I lend a small amount of money without paperwork?

It gets lost just like a large amount. Small amounts are exactly the ones nobody claims because there's no way to prove them; the contract is what makes the microloan collectible.

Does a microloan need a contract?

Yes. Being small doesn't make it any easier to collect without paperwork.

How much does it cost?

The professional fee, from $45, covers drafting and authentication; the notary fee is separate.

Is there a limit on interest?

Yes, just like any loan; usury is a crime.

Does it work for my business?

Yes, it's designed for small businesses.

Do I need a guarantee?

No, a microloan doesn't include one; if you want one, see the Secured loan agreement.

Do you have an agreement for microfinance institutions?

Yes, Financial Partners.

About this procedure

A microloan is a low-amount loan aimed at entrepreneurs, microbusinesses and small businesses that need working capital or a one-time boost, and that often can't get access to traditional banking. Legally, it works as a loan (mutuo), but with its own features: small amounts, short terms, frequent installment payments and a fast process. Being small doesn't mean it can be done any old way: a microloan without a clear contract is just as hard to collect as any other loan, and the interest is still subject to legal limits, because usury is a crime no matter the size of the loan. We draft it clearly and simply, with the amount, installments, term, payment method and interest within the law, and authenticate it before the notary to give it a fecha cierta and backing. This product is especially useful for those in the microfinance business, who make many small transactions: microfinance institutions, credit unions and lenders who serve entrepreneurs. For them, every one-off contract is friction; that's why we offer our Financial Partners agreement, with a preferred volume rate and fast contracts.
