Eviction notice

Before a government notary office · SAREN

It's the notice through which the notary formally delivers to the occupant or tenant the demand to vacate or move out of a property, and certifies that delivery. It proves you gave notice, a necessary step. It isn't the eviction itself, which only a court can order.

FAQ

What happens if I just tell the tenant verbally or by text message?

You get to court unable to prove you made the demand, and the case starts from scratch. The notarial notice is the proof the judge is going to ask for.

Can I remove the tenant with this?

No. Serving the eviction notice proves you gave notice; only a court can order someone removed.

How much does it cost?

The professional fee, from $85, covers drafting and handling at the notary office; the official notary fee is separate, and the notary's trip to the property is charged by distance.

What if they refuse to accept it?

The notary records that, and the notice still takes effect.

Do I need a lawyer?

For the court stages, yes.

About this procedure

Getting back a rented property almost always starts with formal notice: telling the tenant, with proof, that they must move out or that the lease has ended. This notice does exactly that: the notary goes to the property, delivers the notice and uses their fe pública (the notary's legal power to certify facts and documents) to certify that it was served, where, when and on whom. That gives you reliable proof that you gave notice, something you're going to need later. Now, the most important point, said honestly: serving an eviction notice is not evicting. Only a court can order a person removed from a property by force, after the proper proceedings, and in Venezuela housing has special legal protection that must be respected. The notary serves the notice and certifies it; the notary doesn't carry out the eviction or authorize you to take matters into your own hands. What we give you is formal, documented notice, plus honest guidance on what comes next and when you need your lawyer and the court route. We draft the notice on the right legal grounds and coordinate the notary's trip, which is a separate cost depending on distance, and we tell you that cost up front.
