Secured loan agreement

Before a government notary office · SAREN

It's a loan agreement backed by collateral: a pledge on movable property or a mortgage on real estate. If the borrower doesn't pay, the lender can enforce that collateral to collect. It gives you far more security than a plain loan. A mortgage, on top of that, is recorded at the registry.

FAQ

What happens if I lend a large sum without collateral?

If you don't get paid, you're left with a long lawsuit against someone who may no longer have anything. With a pledge or a mortgage, you have a specific asset to collect from.

Which is better, a pledge or a mortgage?

It depends on the asset: a pledge for movable property, a mortgage for real estate; the mortgage is stronger, but it's recorded at the Registro Inmobiliario.

How much does it cost?

The professional fee, from $70, covers the loan and the collateral drafted together and their authentication; the official notary fee is separate, as are the official registry fee for the mortgage and the appraisal of the asset.

Is there a cap on interest?

Yes, going over it is usury, which is a crime.

Do you have an agreement for pawnshops?

Yes, the Financial Partners Program.

About this procedure

A secured loan takes the loan agreement to the next level of security: on top of the obligation to repay, it puts collateral on a specific asset that answers for the debt. There are two main types. A pledge covers movable property (a vehicle, machinery, jewelry, merchandise), and it's the typical tool of pawnshops. A mortgage covers real estate and carries the most weight, although it has to be recorded at the Registro Inmobiliario (Real Estate Registry) to take full effect against third parties. The advantage for the lender is huge: if the borrower doesn't pay, you're not left with a mere piece of paper you have to collect on through a long lawsuit, but with an identified asset you can enforce. That's why it's the preferred tool for large loans. We draft both the loan and the collateral, making clear which asset secures the debt, how it's valued, how it's enforced in case of default and, as always, with interest within legal limits so you don't fall into usury, which is a crime. We coordinate the authentication before the notary, a public official, and if the collateral is a mortgage, we handle the registration for you. And if your business is lending or financing with collateral, like pawnshops and finance companies, this is your day-to-day: that's why we offer our Financial Partners Program agreement, with a preferred rate by volume.
