FAQ

What happens if the contract expires and we just carry on as if nothing happened?

You're in limbo: no clear term, no updated rent and rules that can be disputed if there's a conflict. A signed extension closes that gap.

Is the extension the same as the tenant's statutory extension?

No. The voluntary one is agreed on by the parties; the statutory one is a right the tenant has when the contract ends. We explain which one applies.

How much does it cost?

The professional fee, from $45, covers drafting and authentication; the official notary fee is separate.

Can I change the rent in the extension?

Yes, it's stated expressly, just like the new term.

Do both parties have to sign, and is it authenticated?

Yes, both sign and it's authenticated to give it binding force and fecha cierta (a legally certain date, so the document holds up against third parties).

About this procedure

A contract extension is the agreement by which the parties extend the term of a contract for a new period, so they don't have to draft and negotiate a new one from scratch. It's one of the most requested documents, especially for leases (residential, commercial, land) and for service and supply contracts that work well and that both parties want to continue. The extension sets the new term, the date it runs from, and whether the other conditions stay the same or change (for example, a new rent amount). It's important to tell it apart from the automatic renewal that some contracts already include: when the contract doesn't provide for one, or when the parties want an express record of the extension, a written, authenticated extension is what gives you certainty. A sensitive point in leases is that a voluntary extension shouldn't be confused with the statutory extension (prórroga legal), which is a right the law gives the tenant when the contract ends; we guide you on that difference based on your case. We draft the extension tied to the original contract, with the new term and clear conditions, and we get it authenticated. If you also want to change other clauses, we combine it with a Contract addendum in the same act.
