Acknowledgment of a private document
It's the act in which, before the notary, you acknowledge as your own the signature and content of a private document that already exists. With that, the document gains fecha cierta and legal force it didn't have before; it's different from signing a new one, because nothing is created here: you reinforce what you already signed.

FAQ
What happens if I keep the private document as it is?
It has no fecha cierta against third parties, and in a lawsuit the other side can deny the signature. Acknowledging it before the notary gives it the force it doesn't have today.
How is it different from authenticating?
Here the document already exists and is already signed; it gets acknowledged.
How much does it cost?
The professional fee, from $40, covers handling the acknowledgment at the notary office; the official fee, per page, is separate.
What does my document gain?
Fecha cierta and much more evidentiary weight; it works for a promissory note or a private contract.
Does the person who signed have to go?
Yes, they're the one who acknowledges it, with a valid cédula.
About this procedure
The acknowledgment of a private document is the act in which the person who signed a private document appears before the notary and acknowledges that signature and the document's content as their own. Why does it matter? Because a private document (a contract between individuals, a promissory note, a receipt, a letter of commitment) only has value between those who signed it and, until it's given fecha cierta, it's easy to dispute when it was really signed. With the acknowledgment before the notary, the document gains fecha cierta and much greater evidentiary weight: between the parties, it becomes about as effective as a document executed before a public official. It's different from authenticating a new document: here the document already exists and is already signed; what happens is that its author formally ratifies it before the notary. It's especially useful when you're holding an important private document and want to make it airtight, or when the other party asks you to acknowledge your signature so they can enforce it. We review the document, explain the exact effect of the acknowledgment in your case, and handle the act at the Notaría Pública (government notary office). If what you have is a document that still has to be drafted, rather than acknowledging it, it's better to authenticate it from the start; we'll guide you on which option suits you.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- The acknowledgment gives a private document fecha cierta and evidentiary weight, but it doesn't turn it into a recorded public document
- If the matter involves real estate or transactions that require registration, the acknowledgment is one step, not the last; we'll tell you upfront
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
