FAQ
What happens if the substantive error stays on my record?
It affects your identity, your parentage or your marital status, and no office will correct it voluntarily. Only a judge can order it.
When does a correction go through the courts?
When the error affects the substance of the record; then a court decision is needed.
How much does it cost?
The professional fee, from $120, covers the lawsuit and our support in court; official fees and court costs are separate.
Do you handle the lawsuit?
Yes. We draft the lawsuit and stay with you through the judgment and its marginal note.
What does the timing depend on?
On the court; we confirm it when we review your case.
About this procedure
Some errors in records are considered substantive by law, and those can't be fixed with a simple procedure at the Registro Civil: they require a court proceeding. We're talking about serious matters like an error in parentage or in a person's identity, discrepancies that change who is who on the record, or situations where a correction affects third parties' rights. The law reserves these cases for the ordinary courts precisely because of how serious they are. It's a longer, more delicate procedure, with a lawsuit, evidence and a judgment, and it's no place to improvise. We handle the entire case for you: we assess whether your case is truly substantive, draft and file the petition with the competent court, submit the evidence, follow the proceeding and, once the judgment is issued, record it at the Registro Civil so your record is finally corrected. We get you out of the maze, with a lawyer leading the way.
Legal framework and important notes
Ley Orgánica de Registro Civil (Organic Civil Registry Law) · Código Civil (Civil Code)
- Court route (article 149 of the LORC, Venezuela's Organic Civil Registry Law). It applies when the error or omission affects the substantive content of the record; the case goes to the ordinary courts with a lawsuit, evidence and a judgment, which is then recorded
- Different from the administrative correction (article 145), for errors that don't affect the substance
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
