FAQ

What happens if I let the deadline on a tax assessment run out?

The penalty becomes final and there's almost no room left: you pay what SENIAT said, whether it was right or not. The deadlines are short and they don't stop.

Can I fight a SENIAT tax assessment?

Yes: with a written defense or a recurso jerárquico, within the legal deadlines.

How much does it cost?

The professional fee, from $300, covers reviewing the assessment and drafting and filing the written defense or appeal; it's adjusted based on the complexity and the amount.

Do you guarantee a win?

No: the decision belongs to SENIAT or the higher authority; we build the best legal defense.

And if I lose the appeal?

There's still the tax court route, which is quoted separately.

About this procedure

When SENIAT serves you with an acta de reparo (tax assessment notice) or a penalty, that decision isn't the final word: the law gives you the right to formally defend yourself. You can file a written defense within the proceeding itself, or lodge a recurso jerárquico so a higher authority reviews the decision and revokes or reduces it. Many taxpayers pay unfair assessments simply because they didn't know they could appeal, or because they let the deadline to do so run out.
And here, timing is everything. Appeals have strict legal deadlines: once you're served with the decision, you have a set number of days to file your defense or appeal, and if that window closes, the penalty becomes final and there's almost nothing left to do. That's why reacting fast, with a technically sound filing, is the difference between overturning or reducing an assessment and being stuck with a fine that could have been fought. It's not about complaining angrily: it's about building a solid legal and evidentiary argument.
We prepare and file your defense: we analyze the assessment or the penalty, identify the legal defects and the arguments in your favor, support the written defense or the recurso jerárquico with legal grounds and evidence, and file it on time with SENIAT. We fight, through legal channels, to overturn or reduce what you're being charged with. The price starts at $300 and is adjusted based on the complexity and the amount in dispute. An advisor reviews your case urgently and confirms before we start, no strings attached.
