FAQ

What happens if I got divorced and don't record the decree?

Until it's recorded, as far as the world is concerned you're still married: you can't remarry or freely dispose of your property. The marginal note on the record is what closes the divorce.

Why record the divorce decree?

So the divorce takes effect against third parties and shows on your marriage record.

How much does it cost?

The professional fee, from $40, covers the recording and the marginal note; official registry fees are separate.

Does the decree have to be final?

Yes, final and non-appealable; we check it for you beforehand.

What do I need?

The certified copy of the final decree; if you don't have it, we can get it for you too.

About this procedure

Many people think they're divorced the day the judge signs the decree, but legally the divorce doesn't take full effect until the decree is recorded at the Registry and the marginal note is added to your marriage record, at the Registro Civil (Civil Registry: births, marriages, deaths) where it's entered. Until then, for banks, registries or if you want to remarry, you still show up as married. The Ley Orgánica de Registro Civil (Organic Civil Registry Law) requires the decree to be entered and the marginal note added to the original record; that's the step that closes the process. We start from your decree and its final enforcement order: we check that it's final, handle the recording at the right Registry and follow up on the marginal note on your marriage record. We stay with you until your marital status is truly updated. If you're still going through the divorce, or later need the updated certificate, we handle those services too.
