FAQ
What happens if I won the paternity suit and don't record the ruling?
The child still has no father on the birth record: without the recording, the declared paternity doesn't take full effect for inheritance, surname or child support.
Why record the paternity suit ruling?
So the court's recognition of paternity takes full legal effect and shows on the record.
How much does it cost?
The professional fee, from $40, covers handling the recording; official registry fees are separate.
Does the ruling have to be final?
Yes, final and non-appealable; we check it for you beforehand.
What do I need?
The certified copy of the final ruling; if you don't have it, we can get it for you too.
About this procedure
A paternity suit is the court case that legally establishes who a person's father is when that isn't shown on the birth record. Just as with a paternity challenge, the court's ruling doesn't update the birth record on its own: for parentage to be established for everyone and show on the birth record, the ruling must be recorded at the Registry and the marginal note (annotation added to a recorded document) added. That registry step is what gives the decision full effect, and it's what allows the child to inherit, carry the surnames and get their documents processed. We start from your final ruling and its final enforcement order: we check that it's final, handle the recording at the Registry and follow the marginal note until the birth record is updated. If you're still in the paternity case or need the child's documents that follow from it, we handle those services too.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Ley Orgánica de Registro Civil (Organic Civil Registry Law)
- The ruling must be final and non-appealable, with its enforcement order.
- Without the recording and the marginal note, the decision has no effect against third parties.
- If the details don't match the record, the Registry raises an objection; that's why we check first.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
