FAQ

What happens if I don't record the interdiction?

Banks and third parties keep treating the person as fully capable: they can sign, sell or take on debt, and you have no way to stop it. Recording it is what protects them.

Why record the interdiction ruling?

So the limitation on legal capacity takes effect against third parties and banks.

How much does it cost?

The professional fee, from $40, covers handling the recording; official registry fees are separate.

Does the ruling have to be final?

Yes, with its enforcement order; we check it for you beforehand.

What do I need?

The certified copy of the ruling with its enforcement order.

About this procedure

Interdiction is the court declaration that takes away a person's management of their own assets because of a condition that keeps them from looking after themselves, and appoints a guardian to represent and protect them. The court's ruling must be recorded at the Registry to take effect against everyone: that registry step is what makes the interdiction enforceable before banks, registries and any third party, protecting the person's assets and giving validity to the acts the guardian carries out on their behalf. We start from your final ruling and its final enforcement order: we check that it's final, handle the recording at the Registry and follow up on the marginal note (annotation added to a recorded document). We stay with you until it's properly recorded. If you still need to bring the interdiction case or formalize the guardianship, we offer those services too, with the sensitivity the case calls for.
