FAQ
What happens if the sale was undone by word of mouth and the termination isn't recorded?
The property stays in the buyer's name for everyone: the buyer can sell it, mortgage it or leave it to heirs. The recorded termination is what gives it back to you.
Can a sale that's already recorded be reversed?
Yes, by agreement or on legal grounds; we draft and record the rescission.
How much does it cost?
The professional fee, from $150, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate, depending on the filing.
Does the property go back to my name?
Yes. Once the termination is recorded, ownership goes back as agreed.
What if the other party doesn't agree?
Then the route is through the courts; we stay with you along that path.
About this procedure
Sometimes a sale has to be reversed: the buyer didn't pay what was agreed, hidden defects turned up in the property, essential conditions weren't met, or both parties simply agree to undo the deal. That's what rescission and termination are for: they render the sale void and aim to put things back as they were, with the property going back to the seller and the money to the buyer, as applicable. You can't just ignore the earlier sale; the reversal has to be documented and recorded so the registry shows who the owner is again. Depending on the case, it's done by mutual agreement or through the courts when there's a dispute. We assess your situation, determine the right route, draft the rescission or termination document, and record or process it so the property and the money legally go back where they belong. When a real estate deal goes sideways, we help you unwind it without losing more.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- Rescission or termination renders the sale void; by agreement it's recorded, and with a dispute it goes through the courts
- It returns the property and the price, depending on the case
- It's subject to the official registry fee
