Out-of-court settlement
It's the agreement by which the parties to a dispute, through mutual concessions, avoid a lawsuit or end one already underway. Its great strength is that it has res judicata effect: what's agreed is closed as if it were a final judgment. It's authenticated before the notary to make it solid.

FAQ
What happens if I settle the lawsuit with just a verbal agreement?
Nothing guarantees the other party will comply, and you can still end up in court with the dispute open. A written settlement has the force of a judgment and closes the matter.
How strong is a settlement?
Between the parties, it has the same force as res judicata: it's as binding as a final judgment.
How much does it cost?
The professional fee, from $65, covers drafting and authentication; the official notary fee is separate.
Does it work both to avoid a lawsuit and to end one?
For both, in practically any dispute that can be negotiated.
What happens if the other party doesn't comply?
You can demand compliance; we advise you.
About this procedure
An out-of-court settlement is one of the most useful and underrated tools in the law: the agreement by which two parties in a dispute, each giving up something, decide to avoid a lawsuit or end one that's already underway. Instead of spending years and money in court, they sit down, negotiate and close the matter. And it has a powerful legal feature: between the parties, a settlement has the same force as res judicata, meaning that once it's signed, what's agreed is as binding as if a judge had issued a final ruling, and the matter can't be argued again. That's why drafting it well is so important: you have to make it crystal clear what each party gives up, exactly what's being resolved and what's closed for good, because ambiguous wording can leave gaps for the dispute to come back to life. It's used for everything: debts, business disputes, conflicts between partners, damages, property boundaries, inheritances. We draft it with a lawyer's precision, taking care of the scope and the concessions, and authenticate it before the notary to give it fecha cierta (a legally certain date, so the document holds up against third parties) and maximum solidity. A good settlement agreement saves you an entire lawsuit, and that's the best investment you can make in a dispute.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- A settlement is powerful precisely because it closes the matter like a judgment; that's why the wording has to be surgical. Anything poorly defined can revive the dispute or leave loose ends
- Remember that it involves mutual concessions, both parties give up something
- Done right, it saves you the cost, time and wear and tear of a full lawsuit
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
