FAQ

What happens if someone files for a trademark identical to mine and nobody tells me?

It gets granted, because SAPI doesn't notify you: nobody does. You can only oppose if you find out within the Bulletin deadline.

Why do I need a watch if I've already registered?

Because you can only oppose a copycat if you find out in time.

How much does it cost?

The professional fee is from $25 a month per trademark; if you decide to oppose, the opposition is quoted separately.

Does SAPI notify me?

No: nobody warns you; that's why the Bulletin needs watching.

Can I cancel?

Yes, with advance notice.

About this procedure

Registering your trademark isn't the end of the story: it's the start of looking after it. Every day, new trademark applications come out in the Industrial Property Bulletin (SAPI's official publication for applications), and among them there may be one dangerously similar to yours, in your class or a neighboring one. The law gives you the chance to oppose it, but on one tough condition: only within the deadline that publication opens. If you don't find out in time, the window closes and the other trademark moves ahead.
The catch is that no one at SAPI calls to warn you, and you can't be reading the Bulletin every day. That's how many trademark owners discover a copycat when the damage is already done, when the look-alike trademark has already been granted and is confusing their customers, and they're stuck with the long, expensive fight to annul a granted registration instead of filing a simple opposition in time. A watch service turns that lottery into a system.
We set up that system for you: we monitor SAPI's Bulletin continuously, pick out the applications that pose a risk to your trademark, and alert you as soon as one appears so you can decide, with time to spare, whether to oppose. It's a monthly subscription from $25 that gives you peace of mind all year. A lawyer reviews any alert with you, no strings attached.
