Commercial lease
The lease to rent a store, office or warehouse for commercial use, authenticated before a notary. Unlike a residential lease, a commercial lease follows rules that give the parties more freedom to agree on rent, term and guarantees. A good lease is your best shield against nonpayment.

FAQ
What happens if I rent out my store with a lease downloaded from the internet?
A generic template doesn't protect what matters to you: the rent adjustment, the grounds for termination and who pays for what. When a dispute comes, those weak clauses turn into months of fighting to get your space back.
Is a commercial lease governed the same way as a residential one?
No; a commercial lease gives the parties more freedom to agree on terms.
Can I set the rent in dollars?
Yes; the Civil Cassation Chamber of the Supreme Court confirmed it's valid in a June 2024 ruling, and the tenant may pay the equivalent in bolívares at the official exchange rate.
How much does it cost?
The professional fee, from $55, covers drafting and authentication; the official notary fee is separate.
Do you have a rate for agencies?
Yes, a partner rate.
About this procedure
A commercial lease is the contract used to rent property for commercial use: a store, an office, a warehouse, a going business (fondo de comercio). Unlike residential rentals, which are heavily regulated and strongly protect the tenant, commercial and professional-use leases give the parties much more freedom to agree on terms: the rent, how it's adjusted, the term, the guarantees and the penalties. That freedom is an advantage, but also a risk: if the lease is poorly drafted, you're the one who loses, whether you're the landlord or the tenant. That's why drafting is what matters here: making clear the rent clauses and their inflation adjustment, the guarantees, the term and renewal, the grounds for termination and what happens if rent goes unpaid. A key, current fact: the Civil Cassation Chamber of Venezuela's Supreme Court of Justice (Tribunal Supremo de Justicia), in a June 2024 ruling, confirmed that setting the rent in foreign currency is valid, something widely used today to guard against inflation. The lease is authenticated before the notary at the Notaría Pública (government notary office) to give it fecha cierta (a legally certain date, so the document holds up against third parties) and legal force. With our real estate focus, we draft the lease to truly protect you. And since real estate agencies handle these contracts all the time, they get our preferred partner rate; tell us your volume and we'll set up an agreement.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Ley de Regulación del Arrendamiento Inmobiliario para el Uso Comercial (Commercial Lease Regulation Law)
- In a commercial lease, the freedom to negotiate is your advantage, but only if the lease is well made; a weak rent or termination clause can cost you dearly
- That's why we focus on the drafting
- Remember that landlord and tenant sign in person before the notary
- And if you're a real estate agency, ask about the partner rate
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
