Land lease
The lease to rent land or a parcel, authenticated before a notary. It has a point of its own you won't find in other rentals: what can be built on the land and who keeps those improvements when the lease ends. Getting that right avoids the most common dispute in these cases.

FAQ
What happens if I rent out my land without spelling out what happens to buildings?
That's the classic dispute: when the lease ends, the tenant claims what they built and you can end up in court over your own land. The lease defines from day one who keeps the improvements.
What's most important in a land lease?
Defining who keeps the improvements, whatever gets built, when the lease ends.
How much does it cost?
The professional fee, from $50, covers drafting and authentication before the notary; the official notary fee is separate.
Does it work for farming or commercial use?
Yes, for any use; the lease defines which one.
Do you have a rate for agencies?
Yes, a partner rate.
About this procedure
A land lease is the contract used to rent a lot, a parcel or a plot, for a wide range of uses: farming, parking, storage, commercial, or putting up something temporary. It shares many clauses with any lease (rent, term, guarantees), but it has a point of its own, and a delicate one, that must be locked down no matter what: improvements (bienhechurías). If the tenant builds or improves something on the land (a structure, an improvement, a warehouse), who keeps it when the lease ends? Do they take it with them, does the owner pay for it, or does the owner keep it for free? That's the classic dispute in land rentals, and if the lease doesn't make it clear from the start, it ends up in court. That's why, besides the permitted use of the land, we carefully draft what can be built and what happens to it at the end. The lease is authenticated before the notary at the Notaría Pública (government notary office) to give it fecha cierta (a legally certain date, so the document holds up against third parties) and legal force. With our real estate focus, we watch exactly the points others miss. And since real estate agencies also handle land, they get our preferred partner rate; tell us your volume and we'll set up an agreement.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- Improvements are the heart of a land lease. What can be built and who keeps it at the end; if that isn't clear from day one, a dispute is guaranteed
- That's why we draft it carefully
- Have the land's boundaries and measurements on hand
- The parties sign in person before the notary
- And if you're a real estate agency, ask about the partner rate
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
