Residential lease
The lease to rent a house or apartment for residential use. It's governed by special laws that protect the tenant, and since August 2026 there's a new, more flexible regime. Depending on the lease date, one law or the other applies: we guide you and draft the right one.

The official notary fee and, if your regime requires it, the SUNAVI procedures. Official amounts are paid in bolívares The lawyer gives you the exact figure before you pay anything, no strings attached.
FAQ
What happens if I rent out my home without a well-drafted lease?
Housing is the regime that protects tenants the most, and a weak lease can leave you unable to get your property back for years. Doing it right from the start is what protects you as an owner.
Which law applies to my lease?
It depends on the signing date: leases signed before the new 2026 housing law are governed by the previous rules; new ones, by the 2026 law, which isn't retroactive.
Can I set the rent in dollars?
The new 2026 law expressly recognizes it, in article 14, and the tenant can always pay the equivalent in bolívares at the official Central Bank of Venezuela (BCV) exchange rate.
How much does it cost?
The professional fee, from $55, covers drafting and handling; the official notary fee is separate.
Do you have a rate for agencies?
Yes, a partner rate.
About this procedure
A residential lease is one of the most delicate contracts in Venezuela, because it's heavily regulated and the law strongly protects the tenant. And there's something few people know that can get you into trouble: today two legal regimes coexist. Leases signed before August 7, 2026 remain under the 2011 Ley para la Regularización y Control de los Arrendamientos de Vivienda (Residential Lease Regulation Law), the most protective one, which gives a central role to the Superintendencia Nacional de Vivienda (SUNAVI, the national residential lease authority) and restricted setting the rent in dollars. New leases, from that date on, are governed by the new 2026 Ley del Régimen Especial de Arrendamiento de Inmuebles destinados a Vivienda (Special Residential Lease Regime Law), which is far more flexible: it allows the lease to be authenticated at any Notaría Pública (government notary office) or even signed privately, lets the parties set the rent freely, and expressly recognizes agreeing on it in local or foreign currency. This dual regime is a minefield: drafting a lease under the wrong law can leave it void or open to challenge. That's why our first step is always to identify which law applies to your case, and then draft the right lease, with the rent, guarantees, term and protections the law requires. With our real estate focus, we guide you through that maze and hand you a solid lease. And since real estate agencies handle residential rentals every day, they get our preferred partner rate; tell us your volume and we'll set up an agreement.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Ley de Arrendamiento de Vivienda (Residential Lease Law)
- The critical point in housing is correctly identifying which law applies, because drafting under the wrong rules can leave the lease void or open to challenge; that's always our first step
- Careful with rent in dollars. It depends on the regime
- And if your case falls under the 2011 law, there are obligations to SUNAVI you shouldn't skip
- If you're a real estate agency, ask about the partner rate
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
