FAQ

What happens if I just "eyeball" the employee's final settlement?

You underpay and they claim the difference, with interest, before the Inspectoría del Trabajo (labor inspectorate), or you overpay and give money away. A properly done calculation is what closes the relationship without claims.

What does a final settlement include?

Prestaciones sociales, interest, unused vacation and pending bonus, prorated utilidades and, if applicable, indemnity.

How much does it cost?

The professional fee, from $65, covers the full calculation for one employee with complete data; several employees are quoted as a package.

How are prestaciones sociales calculated?

With the dual system of article 142: quarterly guarantee versus the retroactive calculation of 30 days per year; the more favorable one wins.

Does it work for resignation and dismissal?

Yes, the items change depending on the reason.

About this procedure

When an employment relationship ends, through resignation or dismissal, the employee's final settlement has to be calculated, and that calculation is ground where mistakes get very expensive. The LOTTT defines several items that add up: the accrued prestaciones sociales with their interest, unused vacation and the pending vacation bonus, prorated utilidades and, if the dismissal was unjustified, the corresponding indemnity. Each item has its own calculation base, and mixing them up or getting them wrong is the number one cause of labor lawsuits.
The heart of the calculation is the prestaciones sociales under article 142 of the LOTTT, which the law requires to be calculated two ways: on one side, the quarterly guarantee that should have been deposited along the way, and on the other, the retroactive calculation of 30 days per year at the last full salary (salario integral); the employee gets whichever result is more favorable to them. With inflation and salary changes, doing this by hand and getting it right is complicated, and a wrong number, too high or too low, brings you trouble.
We calculate the full final settlement, item by item, under the LOTTT, and hand you a clear, defensible breakdown, signed by a licensed accountant, so you pay what's fair and you're covered against any claim. The price starts at $65 per employee and goes up depending on seniority and how complex the case is. An accountant reviews the case and gives you the exact figure before we start, no strings attached.
