Notarial service of a summons

Before a government notary office · SAREN

The service in which the notary serves a summons or notice backed by fe pública, typically when a court authorizes it as a complementary method, or when you need reliable proof that you summoned or called someone. It leaves proof of delivery, with fecha cierta (a legally certain date, so the document holds up against third parties).

Is it for you?

If any of these sounds like you, this procedure is for you.

  • For anyone who, within a legal matter, needs to serve through a notary office a summons or notice that the court allows or authorizes as a complementary method, or to make a reliable record of a call to appear, usually working alongside their lawyer

What's included and what isn't

Everything clear from the start. No fine print.

Includes

  • Review of whether your case allows the summons or notice to be served through the notary office.
  • Preparation of the act.
  • Coordination of the notary's travel.
  • Service of the summons or notice.
  • Delivery of the record certifying it was served, so you can file it where it belongs.

Does not include

  • It does NOT replace the summons ordered by the judge and served by the court to start a lawsuit; only the court can do that.
  • Representation in the lawsuit or in-depth procedural advice, which is your lawyer's job.
  • The official notary fee or the notary's travel, which are paid separately.

FAQ

What happens if I can't prove the person was summoned?

The matter falls apart on procedural grounds; without reliable proof of the summons, everything that follows can be challenged.

Does this replace the court's summons to file a lawsuit?

No; that one is ordered by the judge and served by the court. The notary office steps in only in the cases the law or the court allows as a complementary method.

How much does it cost?

The professional fee, from $85, covers preparation and the notary step; the official notary fee is separate, and the notary's travel is charged based on distance.

So what is it useful for?

To leave reliable proof, backed by fe pública, that you summoned or notified someone.

Do I need a lawyer?

In court matters, yes; we work hand in hand with your lawyer.

About this procedure

Let's start with what matters most, to avoid any confusion: the summons that starts a lawsuit is ordered by the judge and served by the court, usually through the bailiff (alguacil); a notary office can't replace that. What the notary can do is serve a notice or summons backed by fe pública in the cases the law or the court itself allows as a complementary method, and make an authentic record that the person was actually summoned or notified, where, when and to whom. This is very useful when the court authorizes notice by another method, when you need reliable proof of a call to appear or a demand related to a matter, or when your lawyer needs fe pública backing to show that a notice was served. The notary travels, delivers and certifies. The first thing we do is review your case with sound judgment: if what you need is the summons only the judge can order, we tell you so plainly and point you to your lawyer, instead of selling you something that won't help you. The notary's travel is a separate cost based on distance, and we tell you the amount up front.
