Cohabitation or stable union statement
It's the document in which you and your partner state before the notary, with witnesses, that you have a de facto union. It works for a great many everyday procedures; that said, there's an important legal point worth understanding well before you sign it.

FAQ
What happens if we don't have any statement of our union?
With an insurer, a bank or in an emergency, your partner is legally a stranger. The statement is the fastest proof that the union exists.
Is the notarial statement the same as marriage?
It works for many procedures, but for full property effects the TSJ (ruling 1.682 of 2005) requires a court declaration.
How much does it cost?
The professional fee, from $40, covers drafting and handling the notarial process; the official notary fee is separate.
Does it work for my partner's insurance?
In most cases, yes.
Do I need witnesses, and do they have to go in person?
Usually yes, two, and the couple and the witnesses go with a valid cédula.
About this procedure
The cohabitation (concubinato) or de facto union statement is the document in which a couple declares before the notary, usually together with witnesses, that they have a stable, permanent and public relationship, the kind that article 77 of the Constitution treats as equal to marriage. It's used for a whole range of everyday matters: adding your partner to an insurance policy or to employment benefits, banking procedures, dealings with institutions, or simply documenting the relationship with fecha cierta (a legally certain date, so the document holds up against third parties). Now, we're honest with you here, because this is the point many people don't explain: there's a difference between the notarial statement and the court recognition of the union. The statement before the notary is a declaration by the two of you, with witnesses, and it works for many procedures that accept it as is. But for it to have full effects comparable to marriage, especially when property or inheritances are involved, the Tribunal Supremo de Justicia (TSJ, Venezuela's Supreme Court of Justice), in its binding ruling number 1.682 of July 15, 2005, made it clear that a court declaration of the stable union, issued by a court, is required. In other words: the notarial statement takes care of day-to-day matters; for significant property effects, you need the court route. We draft and authenticate your statement, and we tell you frankly whether your case is resolved with it or whether it's better to go for the court declaration, so you don't buy a document thinking it does something it doesn't.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Constitución de la República Bolivariana de Venezuela (Constitution of Venezuela)
- Let's be clear about the scope. The notarial statement takes care of a great many everyday procedures, but it doesn't replace the court declaration of the stable union when property, inheritances or pensions are at stake
- We tell you straight which one you need, so we don't sell you a paper that doesn't do what you expect
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
