Certified date record (fecha cierta)

Before a government notary office · SAREN

The certified date record is the act by which the notary records that a document was presented before them on a specific date. With that, a private document gains fecha cierta that can be enforced against third parties, something a handwritten date doesn't guarantee.

FAQ

What happens if my private contract doesn't have fecha cierta?

As far as third parties are concerned, it's as if it had been signed yesterday: anyone can claim you backdated it. The record fixes the date with legal force and settles that argument.

Is this the same as authenticating the document?

No. Fecha cierta fixes the date with force against third parties; notarial authentication certifies that the signatures belong to the people who claim to have signed. They're different acts.

How much does it cost?

The professional fee, from $50, covers handling the notarial process; the official notary fee depends on the number of pages, and we give you the exact amount before we start. Drafting the document isn't included.

Does it work for a contract between individuals?

Yes, that's its most common use.

Does the notary review the content of the contract?

They don't go into the substance; they record the date of presentation.

About this procedure

A private document, such as a contract between two people, a letter or an agreement, carries whatever date the parties put on it, and that date alone doesn't bind a third party, who could always claim it was written later. Fecha cierta solves exactly that: the notary makes an authentic record that the document existed and was presented before them on a specific date, and from that moment on the date can be enforced against anyone. It's not that the notary approves the content or certifies the signatures, that's notarial authentication; what gets fixed with legal force here is the date. It's used all the time for contracts between individuals, loan agreements, documents that will later go to court, or any case where it matters to prove since when the document has existed. We review the document, coordinate the appointment, present it before the notary and return it to you with the fecha cierta record.
