FAQ
What happens if the access or use between the two properties is only a verbal agreement?
The next owner blocks it and you have no way to claim it. A recorded easement binds current and future owners.
What does creating an easement settle?
A right of way or use between two properties, enforceable against current and future owners.
How much does it cost?
The professional fee, from $150, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate, depending on the act.
Do both owners have to sign?
Yes, the owner of the property that bears it and the owner of the one that benefits.
Can it be removed later?
Yes, by a recorded agreement or on the grounds set by law.
About this procedure
An easement is a right one property has over another so it can function: the most common is a right of way, when a property has no access to a public road and needs to cross the neighbor's land to get in and out. But there are also easements for water, aqueducts, electricity, views or drainage. Without a properly created easement, a piece of land can become practically useless for lack of access, or endless disputes can break out between neighbors over a path or a pipe. Creating it formally, with a recorded document, makes clear once and for all what right one property has over the other, its limits and conditions, and heads off lawsuits. We analyze the situation between the properties, draft the easement document defining the right and its terms, and record it at the Registro Inmobiliario so it's on file and enforceable against the current and future owners of both properties. You settle an access or neighbor issue at the root.
