FAQ
What happens if I let someone use my property without creating a usufruct?
Neither do they have a secure right nor do you have control: one day they get put out, or one day you can't get it back. A recorded usufruct defines who uses it, for how long and within what limits.
What does a usufruct let me do?
Let someone use and enjoy the property while ownership stays in other hands.
How much does it cost?
The professional fee, from $150, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate and is calculated on the asset's value.
Can it be for life or for a fixed term?
Both are possible; it's set in the document.
Who pays the taxes and upkeep?
As a rule, the usufructuary; we spell it out to avoid disputes.
About this procedure
A usufruct is the right to use and enjoy a property that belongs to someone else, and even to collect its fruits, such as rent, for a set period or for life, without owning the property as such. It's a very useful arrangement in many situations: giving a family member the right to live in an apartment without taking ownership away from the heirs, letting someone run a commercial space or work a piece of land for a term, or structuring tailored family and estate arrangements. Because it can't be perpetual and has its own rules on obligations and upkeep of the property, the document must be drafted carefully so it's clear what the usufructuary can do, for how long, and what remains with the bare owner. We advise you on how to structure it to fit your goal, draft the usufruct document, and record it at the Registro Inmobiliario so the right is officially on file and enforceable against third parties. You split use from ownership with full legal certainty.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- A usufruct separates use and enjoyment from ownership; it can't be perpetual (max. 30 years when the usufructuary is a legal entity)
- It's created by will and recorded
