FAQ

What happens if I sell apartments without a condominium declaration?

You can't: by law it must be recorded before any unit is sold, and the registry won't record any sale without it. It's the document that gives the building its legal life.

What does the condominium declaration define?

The units, the common areas and each owner's percentage (alícuota).

How much does it cost?

The professional fee, from $200, covers the full drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate, depending on the act.

Can I change the percentages later?

Yes, with the majorities required by law and by recording the amendment.

What do I need?

The title deed for the land, the plans and the municipal permits; we give you the exact list.

About this procedure

The condominium declaration (documento de condominio) is a building's legal birth certificate as horizontal property (the condominium regime): it's the document that takes a property and legally divides it into individually owned apartments or commercial units, plus the common areas that belong to everyone, and assigns each unit its ownership percentage, the well-known alícuota. And here's what many builders find out too late: by law, not a single apartment can be sold, and no right over a unit can be recorded, until the condominium declaration has been recorded along with its approved architectural plans. It's literally the requirement that unlocks every sale in the building. The document describes the land, the building, each unit, the common areas and the percentages, and it must comply with the Ley de Propiedad Horizontal to the letter. We draft your building's condominium declaration in line with the law, coordinate the plans and supporting documents, and record it at the Registro Inmobiliario (Real Estate Registry) so it's legally in place and you can start selling. It's the step that turns your construction into sellable apartments.
