FAQ
What happens if I need to prove a fact and don't have any document?
Without paper, the fact doesn't exist for anyone. The witness affidavit turns what your witnesses know into a statement with fe pública that you can use.
How many witnesses do I need, and can they be relatives?
Two at minimum, and three make it stronger. And it's better if they're not relatives and have no direct interest in the matter, because that weakens the statement.
How much does it cost?
The professional fee, from $60, covers preparing the questions and support at the notary office; the official fee depends on the number of pages, and we give you the exact figure upfront. The client provides the witnesses.
Do I have to go?
The ones who must appear without fail are the witnesses, with a valid cédula; we go with them.
Does the notary decide whether the fact is true?
No. The notary certifies what the witnesses state, but doesn't rule on the merits.
About this procedure
The witness affidavit is one of the quintessential notarial records: two or more people appear before the notary and declare, under oath, a fact they know firsthand, and the notary certifies that statement with fe pública. It's meant precisely for when you need to prove something for which no document exists. The notary doesn't judge whether the fact is true or settle a dispute; they make an authentic record of what the witnesses stated before them, with a fecha cierta (a legally certain date, so the document holds up against third parties) and legal validity. The whole weight of the affidavit rests on the questions: if they don't precisely cover what the authority is going to ask of you, the record won't do you any good. That's why we draft those questions tailored to the use, book the appointment, attend the taking of the statements and hand you the record. It's used every day to prove a de facto union (unión estable de hecho), residence, possession of a property, economic dependency or proof of life.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- A witness affidavit is only as good as its questions. If the questions don't cover what the authority requires, the record is useless and the witnesses have to appear again
- That's why we draft it for the specific use
- And be clear about the limits of this tool. The notary certifies the statement but doesn't settle disputes; that's what the courts are for
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
