About this procedure
The declaration of sole heirs (únicos y universales herederos) is the document that proves who a person's legal heirs are when they didn't leave a will. When there's no will, this declaration is requested from the courts, and banks and institutions require it to recognize the heirs and let them act on the deceased's property and accounts. Once you have it, to be valid outside the country or before certain agencies it usually needs legalization (official verification of a signature or document) and, if it's going abroad, an apostille (Hague Convention certification for use abroad). We start from the declaration you already have: we handle its legalization and process the apostille at the MPPRE (Venezuela's Ministry of Foreign Affairs, which issues apostilles). It's a key document for heirs who live abroad and need to prove their status to handle an inheritance in Venezuela. If you don't have the declaration yet and it has to be requested from the court, we also handle that process as a separate service.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · 1961 Hague Apostille Convention
- Without SENIAT's estate tax compliance certificate (solvencia sucesoral), inherited property can't be sold or moved, not even by an only child.
- If the details don't match the system, the procedure is rejected.
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
