Notice of contract termination
It's the notice through which the notary formally tells the other party about your decision to rescind or terminate a contract, and certifies that delivery. Unlike demanding that they perform, here you're giving notice that the contract is over, and you keep proof of when and to whom notice was given.

FAQ
What happens if I end the contract without formally giving notice?
As far as the other party is concerned, the contract is still alive, and they can keep billing or making claims as if nothing happened. The notarial notice pins down the day it ended.
How is it different from the Notice of breach of contract?
That one demands that the other party perform and puts them in default; this one tells them you're ending the contract.
How much does it cost?
The professional fee, from $85, covers drafting and handling at the notary office; the official notary fee depends on the number of pages, and the notary's trip is charged by distance.
Can I use it to end a lease?
Yes, that's one of its typical uses.
What if they refuse to accept the notice?
The notary records that, and the notice still takes effect.
About this procedure
Ending a contract isn't just a matter of no longer performing it: in many cases you have to formally tell the other party, and keep proof of that notice, so the termination takes effect and can't be disputed later. That's where this notice comes in. The notary goes to the other party's address, delivers your notice of termination and uses their fe pública (the notary's legal power to certify facts and documents) to certify that it was served, where, when and on whom. It's the difference between "I told them" and being able to prove it. It's used to end a lease, terminate a contract because the other party breached it, give notice that it won't be renewed, or exercise a termination clause. Note the nuance: if what you want is to demand that the other party perform and put them in default, that's the Notice of breach of contract; this one is for when you've already decided to end it. We draft the notice on the right legal grounds, coordinate the notary's trip and hand you the notarial record. The notary's travel is a separate cost depending on distance, and we tell you about it up front.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code)
- Be clear on the nuance. This notice is for when you've already decided to end the contract; if you still want to give them a chance to perform, what you need is the notice of breach
- Check whether your contract requires notice a certain amount of time in advance, because that determines when it has to be served
- The notary's travel is a separate cost depending on distance, and we tell you about it up front
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
