Special power of attorney

Before a government notary office · SAREN

You authorize another person to act on your behalf for one specific, defined act: selling an asset, collecting a payment, representing you at a meeting. Unlike a general power of attorney, it's limited to that task. The notary authenticates that the signature is yours.

Everything clear from the start. No fine print.

FAQ

What happens if I leave the task to someone verbally, without a power of attorney?

The bank, the registry or the notary office won't recognize anyone as your representative without an authenticated power of attorney. Without it, the person you trust can't sign for you and the procedure falls apart at the government window.

How much does it cost?

The professional fee, from $55, covers drafting the power of attorney and support through the signing. The official notary fee is a fixed amount plus an amount per page, and it's paid separately; we give you the full figure beforehand.

How is it different from a general power of attorney?

The special one is limited to the act you describe; the general one grants broad powers.

Can the attorney-in-fact do something else with it?

No, only the authorized act. That's why it pays to describe the asset and the conditions well, which is exactly what we take care of when we draft it.

Do I have to sign it myself?

Yes, the signatory signs in person before the notary with their cédula. If you're outside the country, the route is the Venezuelan consulate or a power of attorney signed before a local notary and apostilled (Hague Convention certification for use abroad); we guide you based on where you are.

About this procedure

A special power of attorney is the tool for when you want to grant power for one thing and nothing else. You're not handing over broad management of your affairs, as with a general power of attorney; you're authorizing one specific, well-defined act: selling a vehicle or a property, collecting an amount, representing you at a shareholders' meeting, picking up a document, signing a specific contract. Outside that act, the attorney-in-fact can't do anything else in your name, and that's exactly its advantage: it's limited, controlled and safe. As with any power of attorney, the notary isn't certifying a fact; the notary authenticates that the signature is yours, that you, with your cédula, signed it before them of your own free will, giving it fe pública (the notary's legal power to certify facts and documents) before third parties. The key to a special power of attorney is describing the act precisely: if it says "sell," it must be clear what's being sold and on what terms, so the attorney-in-fact can act without obstacles but without overstepping. We draft it to fit your needs, with the act clearly defined, and coordinate the authentication. The signatory must sign in person before the notary.
