FAQ

What happens if I don't record the legal separation?

As far as third parties are concerned, it doesn't exist: debts and property stay in common as if nothing happened. The marginal note is what gives it real effect.

Why record the legal separation?

So the court-ordered separation takes effect against third parties and shows on the marriage record.

How much does it cost?

The professional fee, from $40, covers the recording and the marginal note; official registry fees are separate.

Does the decision have to be final?

Yes; we check that it's ready before recording it.

What do I need?

The certified copy of the decision; if you don't have it, we can get it for you too.

About this procedure

A legal separation suspends the spouses' duty to live together and, when it includes separation of property, changes their marital property regime; over time, it can be converted into a divorce. For it to take effect against everyone, the separation ruling or decree must be recorded at the Registry and the marginal note added to the marriage record. That registry step is what makes the separation enforceable against third parties, protects each spouse's assets and leaves a record of the new situation. We start from your ruling or decree and its final enforcement order: we check that it's final, handle the recording at the Registry and follow the marginal note on the marriage record. We stay with you until it's properly recorded. If you later want to convert the separation into a divorce, we handle that procedure too.
