Notarial verification of facts

Before a government notary office · SAREN

It's the most general notarial record: the notary attests to a fact or situation they witness directly, when your case doesn't fit a more specific form such as a property inspection or a handover. It leaves an authentic record of what happened, with fecha cierta (a legally certain date, so the document holds up against third parties).

FAQ

What happens if the fact occurs and no one with fe pública records it?

Tomorrow it's gone or has changed, and all that's left are different versions. The verification freezes the fact as it was, with value as evidence.

How is it different from an out-of-court inspection?

The inspection is specifically for recording the condition of a place or thing; this is the general form for facts that don't fit the specific ones.

How much does it cost?

The professional fee, from $85, covers the preparation and the record; the official notary fee depends on the number of pages, and if the fact is verified outside the notary office, travel is charged separately based on distance.

Does the notary give an opinion on the fact?

No; they attest to what they perceive, without judging the substance.

Is there always travel involved?

Only if the fact must be verified outside the notary office.

About this procedure

Notarial verification of facts is the parent form of all on-site notarial records: it covers any fact you need documented with fe pública (the notary's legal power to certify facts and documents) that doesn't fall exactly under a more specific category. The notary perceives the fact directly, in person or on site, and makes an authentic record of what they see or hear, with fecha cierta, without giving an opinion on the substance. It's for what doesn't fit anywhere else: recording that someone did or didn't show up to an appointment, the state of a specific situation, that an act took place, or compliance or non-compliance with something agreed that can be witnessed. A piece of honest advice: if your case is specifically a property inspection, a handover of goods, an inventory or attendance at a shareholders' meeting, those have their own record, better focused and with their own price; write to us and we'll point you to the right one. This verification is for what doesn't fit any of those. We understand the fact, prepare the record and, if travel is needed, coordinate the notary's travel, which in that case is a separate cost based on distance.
