Notarial inventory

Before a government notary office · SAREN

It's the act in which the notary travels and certifies the inventory of the assets at a place: a business's stock, the contents of commercial premises, a company's assets or the assets of an estate. It makes an authentic record of what's there and in what quantity at that moment.

What's included and what isn't

Everything clear from the start. No fine print.

Includes

  • Preparation of the inventory method.
  • Coordination of the notary's travel to the site.
  • Support during the count of the assets.
  • Delivery of the inventory record certifying everything verified.

Does not include

  • Appraisals or valuation of the assets, which is the job of an expert or appraiser; the notary verifies existence and quantity, not price.

FAQ

What happens if I divide an inheritance or transfer a business without an inventory?

Someone always says something was missing. A notarial inventory pins down what was there and how much, and leaves that claim with no ground to stand on.

Does the notary put a price on the assets?

No. The notary verifies what's there and in what quantity, but doesn't value it. That's what an appraiser is for.

How much does it cost?

The professional fee, from $90, covers the organization and the record; the official fee depends on the number of pages, and the notary's travel is charged separately based on distance and the volume of assets.

Does it work for an inheritance?

Yes, that's one of its main uses, taking inventory before dividing.

And for selling a business?

That too, to pin down what's being transferred.

About this procedure

When a set of assets has to be divided, transferred or accounted for, the first thing is to agree on exactly what's there. A notarial inventory takes care of that: the notary travels to the site and records, with fe pública (the notary's legal power to certify facts and documents), the assets that exist, describing and counting them, so there's an indisputable legal snapshot of what was there and in what quantity on that date. It's key in estates, where the deceased's assets have to be inventoried before they're divided; in company dissolutions, to know what's being wound up; in transfers of a business or fondo de comercio (a business as a going concern), to pin down what's being sold; and in separations, for jointly owned property. The notary doesn't appraise or set prices; they record existence and quantity. We prepare the counting method, coordinate the notary's travel, go with them and hand you the record. Since the notary travels to the site, that travel is a separate expense based on distance and volume, and we tell you about it beforehand.
