FAQ
What happens if the heirs don't divide the property?
It stays in everyone's name: nobody can sell or mortgage their share, and each death adds more heirs to the fight. The division gives each portion an owner.
How is an inherited property divided among several heirs?
Through the division, which allocates each heir their share and is recorded at the registry.
How much does it cost?
The professional fee, from $180, covers drafting the amicable division, the visado (a lawyer's sign-off, required before filing a document) and the recording; the registry fee is extra. If it goes to court, it's quoted separately.
Do I need the estate tax compliance certificate?
Yes, before the division; we get it for you.
And if one heir doesn't agree?
The matter moves to the courts; we stand by you on that route.
About this procedure
When a relative dies and leaves a property, that property belongs to all the heirs at once, in a kind of forced partnership where nobody owns a specific part until the division is done. And that's where so many families break apart: one wants to sell, another wants to stay, another never shows up, and the parents' house becomes the siblings' battlefield. The division is the act that splits and allocates the property, and there are two routes: the amicable one, when the heirs agree and the division agreement is drafted and recorded, which is quick and affordable; and the court route, when there's a dispute and you have to go to court, which is long, expensive and painful. Before the division, the inheritance tax return must be filed with SENIAT (Venezuela's tax and customs authority). We advise you firmly and tactfully, always pushing toward the agreement that works for everyone, handle the SENIAT side if it's still pending, draft the division agreement and record it at the registry so each heir finally has what's theirs, clear and in their name. We help the inheritance unite the family instead of dividing it.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Código de Procedimiento Civil (Code of Civil Procedure)
- The division can be amicable (a recorded division agreement, article 1.066 of the Civil Code) or contested in court (articles 777 et seq. of the CPC, the Code of Civil Procedure)
- It requires the inheritance tax return filed with SENIAT (within 180 days of the death) before the division
We guarantee our service, not what the agency decides. If something depends on them, we tell you clearly and in time.
