Power of attorney for litigation
It's the power of attorney through which you authorize a lawyer to represent you in a lawsuit or proceeding before the courts: act for you, file briefs, attend hearings, handle your case. When appropriate, it includes the express powers the law requires, such as accepting the claim, withdrawing the case or settling.

FAQ
What happens if my lawyer doesn't have a power of attorney to act?
They can't represent you in the lawsuit, and there are strong acts they won't be able to perform even with a power of attorney if those acts aren't expressly authorized. It's the first thing they'll ask you for before filing the brief.
How much does it cost?
The professional fee, from $60, covers drafting with the powers your case needs and support at the signing. The official notary fee is paid separately; we give you the full figure beforehand.
What are express powers?
Strong acts such as accepting the claim, withdrawing the case or settling, which the law requires to be stated explicitly in the power of attorney. If they're missing, the lawyer can't carry them out.
Can I grant it to several lawyers?
Yes, it can be granted to more than one, to act jointly or separately.
Do I have to sign it myself?
Yes, the signatory signs in person before the notary. If you're outside the country, it's handled through the consulate or with a power of attorney that carries an apostille (Hague Convention certification for use abroad).
About this procedure
A power of attorney for litigation is the one you give your lawyer so they can represent you in a lawsuit: they can file or answer claims, submit evidence, attend hearings, file appeals; in short, handle your case in court without you having to be there for every step. It's different from a general or a special power of attorney because its ground is litigation, and it has an important legal feature: certain strong powers, such as accepting the claim (convenir), withdrawing the case (desistir), settling (transigir), submitting to arbitration or receiving payments, aren't understood to be included on their own; the law requires them to be stated expressly in the power of attorney. If your power of attorney doesn't mention them and your case needs them, your lawyer's hands are tied at the key moment. That's where the value of drafting it well lies: including exactly the powers your case requires, not too few, which would leave you halfway there, and not too many, without control. As with any power of attorney, the notary authenticates that the signature is yours, giving it fe pública (the notary's legal power to certify facts and documents). Ideally, we review it hand in hand with your lawyer, so the power of attorney fits the case strategy. The signatory must sign in person before the notary.
Legal framework and important notes
Ley de Registros y Notarías (Registries and Notaries Law) · Código Civil (Civil Code) · Código de Procedimiento Civil (Code of Civil Procedure)
- The most delicate part of a power of attorney for litigation is the express powers. If your case may require accepting the claim, withdrawing, settling or receiving payments, those powers must be stated explicitly, or your lawyer won't be able to exercise them
- That's why it's best to draft it hand in hand with your lawyer
- Remember that the signatory signs in person before the notary with a valid cédula
