FAQ

What happens if the building doesn't have recorded rules?

Every conflict between neighbors gets settled by shouting: there's no written rule that binds anyone. Recorded rules are what give the board the authority to enforce them.

Are condominium rules mandatory?

Yes. They come with the condominium declaration and are binding on the owners.

How much does it cost?

The professional fee, from $150, covers drafting tailored to the building, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate.

What do they regulate?

Living together, the use of common areas and the building's rules.

Can they be changed later?

Yes, with the majorities required by law and by recording the change.

About this procedure

Condominium rules (reglamento de condominio) are the set of rules that govern a building's daily life: what each owner can and can't do, how common areas are used, quiet hours, pets, the powers and limits of the condominium board and the property manager, the bond the manager must post, and how decisions are made at owners' meetings. The Ley de Propiedad Horizontal requires the condominium declaration (documento de condominio) to come with these rules, which are binding on everyone and can only be changed by the owners' meeting. Well-drafted rules are the difference between a building where people live in peace and one locked in constant war over noise, pets, parking or who pays what. We draft condominium rules tailored to your building, covering every matter the law requires and anticipating the typical conflicts so they're settled on paper before they blow up. Clear rules from the start, so living together doesn't depend on everyone's goodwill.
