FAQ

What happens if I give away the property verbally or with a simple document?

There's no gift: the property is still yours, and when you die it goes into your estate with everything else. Only recording makes the donee the owner.

Can a property gift be undone?

As a rule, no. The Civil Code only allows revoking it in specific cases, such as ingratitude of the recipient or the later birth of children to the donor (arts. 1.459 et seq.).

How much does it cost?

The professional fee, from $150, covers drafting, the visado (a lawyer's sign-off, required before filing a document) and recording; the official registry fee is separate and is calculated on the asset's value. There may be a gift tax; we guide you.

Do both parties have to sign?

Yes, donor and donee, because the gift must be accepted.

Can I gift it and keep living there?

Yes, by reserving the usufruct for yourself in the same document.

About this procedure

Gifting a property means transferring it free of charge to another person, usually a child, a relative or someone you love, while you're still alive. It's one of the best ways to put your assets in order and spare your loved ones the tangle of an estate down the road, but it has to be done right because it has strict rules: a gift is irrevocable except on very specific grounds set by law, it can't cover all your assets and leave you with nothing, and the person receiving it must accept it for it to be valid. It's also recorded at the Registro Inmobiliario so the property actually ends up in the donee's name. A poorly drafted document can be challenged or spark family fights. We advise you on the best way to do it based on your intent, draft the gift deed with clauses that protect both you and the recipient, check that the property has a clear title, and record it. You leave your assets where you want them, in order and with no loose ends for later.
